1. GENERAL PROVISIONS
The service www.edenhill.ro is provided by EDEN S.R.L. (hereinafter referred to as “Eden Hill”), with its registered office in Olt County, Caracal, Intrarea Muzeului Street, registered with the Trade Register under no. J28/15/1993, having VAT code RO3375331.
These Terms and Conditions apply in the context of accessing the Website and/or making reservations and purchasing tourist services through the platform www.edenhill.ro, within the Eden Hill Retreat&Spa accommodation unit.
Browsing the website www.edenhill.ro, followed, as applicable, by making a reservation, is equivalent to reading, understanding, and fully accepting the Terms and Conditions below by any User/Client, acting as a consumer or professional.
Eden Hill reserves the right to make changes to the content of this website, as well as to these Terms and Conditions, without any prior notice to Users/Clients. In the event of disputes between Eden Hill and Users/Clients, the Terms and Conditions valid at the time of their acceptance by the User/Client shall apply.
2. DEFINITIONS
“Platform/Website” – the online platform www.edenhill.ro;
“Document” – the present version of the Terms and Conditions;
“Client” – any person, consumer or professional, who makes a reservation and purchases the tourist services offered by Eden Hill;
“Content” includes the following elements:
- all information available on the website www.edenhill.ro that can be visited, viewed, or otherwise accessed using digital equipment;
- the content of any email sent to Users/Clients interacting with the Website by Eden Hill through electronic means and/or any other available means of communication;
- any information communicated to Users/Clients by any means by an Eden Hill employee, according to the contact information specified by the User/Client;
- data relating to Eden Hill or other privileged Company data.
“Distance contract” – any contract concluded without the simultaneous physical presence of the contracting parties, using one or more means of distance communication;
“Personal data” – any information relating to an identified or identifiable person (“data subject”). Personal data include (non-exhaustive): first and last name, email address, phone number, etc.;
“Personal data controller” – the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of processing personal data. With regard to the Website, the data controller is Eden Hill;
“Consent of the data subject” – any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which they accept, by a statement or by a clear affirmative action, the processing of personal data concerning them;
“Processing” – any operation or set of operations performed on personal data (with or without automated means), such as collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure, dissemination, making available, alignment, combination, restriction, erasure, destruction, etc.;
“User” – any person who accesses the Website for information and consultation of the Eden Hill offer, regardless of whether they place a reservation for hotel services.
3. GENERAL POLICY
3.1. General provisions
This Document sets out the terms and conditions for using the Website/Content by Users/Clients. Users/Clients are advised to carefully read this document to prevent potential unwanted/unpleasant consequences that may be perceived as having a negative impact on their data and/or the information provided to EDEN S.R.L.
Access to the service is carried out through the website www.edenhill.ro, by phone at 0733.364.455, or by email at [email protected].
By using the Website, the User/Client is solely responsible for all activities resulting from its use. They are also liable for any damages caused to the Website and/or Content provided by Eden Hill, in accordance with applicable national legislation.
If the User does not agree with these Terms and Conditions, they may send an email to [email protected] specifying the reasons and/or requests for desired changes.
The User may at any time reconsider their decision not to agree with and/or accept the Terms and Conditions.
The Client may not revoke the consent expressed regarding the Terms and Conditions during the performance of a Contract or until all outstanding Contracts and applicable penalties, according to the cancellation/no-show policy described herein, have been settled.
The Website name and its graphic elements are the property of Eden Hill and may not be taken, copied, or used without the written consent of the owner.
All Content presented or displayed on the Website, including but not limited to text, graphics, photographs, images, moving images, sound, illustrations, etc., is the property of Eden Hill. All elements of the services offered by Eden Hill, including the overall design, are protected by copyright and intellectual property laws.
The name “Eden Hill”/“edenhill.ro”, associated logos and symbols, and combinations thereof with any word or graphic symbol, used on the Website, are registered trademarks and the exclusive property of EDEN S.R.L. They may not be used by third parties without prior consent.
Users/Clients may not modify any of the aforementioned materials and may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell information or works contained on www.edenhill.ro.
Except as permitted by applicable copyright law, Users/Clients are responsible for obtaining permission before using any copyrighted material made available by Eden Hill.
Any Content accessed by Users by any means falls under these Terms and Conditions if it is not accompanied by a specific and valid usage agreement concluded between Eden Hill and the User, and without any express or implied warranty from Eden Hill regarding such Content.
Communications of any information or data in the form of messages, text, images, audio and/or video files, or any other materials, regardless of publication or transmission method, by any person other than Eden Hill, are the sole responsibility of the respective person, Eden Hill bearing no responsibility for their content or publication method.
If Eden Hill grants the User the right to use certain Content under a separate usage agreement, this right extends only to the Content defined therein and only for the duration specified, without constituting any commitment by Eden Hill toward the User or any third party who may access such Content.
No Content transmitted to the User by any means or obtained through access, visitation, and/or viewing constitutes a contractual obligation of Eden Hill or its employees.
Any use of the Content for purposes other than those expressly permitted by these Terms and Conditions or a separate agreement is prohibited.
The User is liable for any damages caused to the Website/Content in accordance with Romanian law.
3.2. Contact data and information
Eden Hill publishes complete and accurate identification data on the Website to facilitate contact by Users/Clients.
Accessing the Website, using the information therein, visiting pages, or sending emails or notifications to the Company may be carried out electronically, by phone, or by any other available means, and Users/Clients are deemed to consent to receiving notifications electronically and/or by phone, including emails or Website announcements.
Eden Hill reserves the right not to respond to all requests, especially if unfounded/abusive/offensive.
Users/Clients expressly declare that the contact data provided belong to them and may be used by the Company for communications and to resolve requests or provide additional information.
4. RATES
All rates displayed on the Website are per night of accommodation and include the “Welcome package” and VAT (9%). Rates do not include hotel or other local taxes.
Eden Hill reserves the right to modify rates at any time, respecting confirmed reservations.
Rate increases may be determined by increased taxes or the introduction of new taxes. Confirmed reservations remain unaffected.
5. MAKING RESERVATIONS
Reservations, subject to confirmation by Eden Hill, may be made:
- via the online booking platform on www.edenhill.ro, section REZERVA/BOOK NOW;
- via Booking.com.
6. PAYMENT AND CONFIRMATION OF RESERVATIONS
Available payment methods:
- bank transfer;
- online payment by bank cards – VISA (including Electron), MasterCard (including Maestro).
Reservations are finalized upon payment confirmation.
Clients must verify invoice details before payment. Payment constitutes express confirmation of the invoice.
Clients are solely responsible for the accuracy of billing data.
7. MODIFICATION. CANCELLATION. NO-SHOW. PENALTIES
Any modification and/or cancellation must be sent in writing to [email protected] and is subject to approval.
Cancellations:
- without penalties if made at least 14 days before the reservation date;
- with a 100% penalty if made less than 14 days before.
No-show means failure to arrive for a confirmed, non-cancelled reservation. In this case, the advance payment is fully retained.
Access to the location is possible only with vehicles properly equipped for winter conditions; a 4x4 vehicle is recommended.
8. CHECK-IN & CHECK-OUT
Check-in starts at 16:00.
Access key details are sent by email after online check-in formalities are completed.
As check-in/check-out are exclusively online, a copy/photo of an ID of one guest must be uploaded during online check-in, used solely for legal documentation and exceptional situations.
We guarantee data protection according to the Privacy Policy.
Check-out must be completed by 11:00.
Late check-out after 11:00 incurs a 50% fee of one night.
Exit from the unit must be completed by 13:30; after this, a full additional night is charged.
9. SMOKING
Smoking is strictly prohibited inside Eden Hill, except in designated areas.
10. PARKING
Free parking is available.
11. SAFETY. SPECIAL NEEDS
Eden Hill is not responsible for lost, forgotten, or stolen items, nor for accidents resulting from improper use of facilities.
12. PETS
Pets are not allowed.
Eden Hill may refuse accommodation to Clients accompanied by pets, with a penalty of 100% of the first night.
13. VISITORS
Visitors are not allowed.
14. ENVIRONMENTAL PROTECTION AND CLEANLINESS
Environmental protection is a постоян concern.
Bed linen and towels are changed every 2 days or upon request.
15. CONDUCT AND RESPONSIBILITIES
Eden Hill reserves the right to refuse accommodation to intoxicated or disruptive Clients.
Clients are liable for damages caused to others, staff, furniture, equipment, etc.
Clients must not damage property; otherwise, they owe at least the value of the damaged item plus labor costs.
Clients acknowledge that goods are of premium quality.
16. COMPLAINTS
Complaints regarding service quality may be submitted by email to [email protected].
Complaints that could have been remedied during the stay will not be considered later.
Complaints regarding theft or damage to personal property must be reported within 24 hours of discovery.
17. DISPUTE RESOLUTION
Any dispute shall be resolved amicably; failing that, by the competent courts in Bucharest or Ilfov.
Invalidity of any clause does not affect the validity of the others.
Eden Hill is not liable for losses caused by non-compliance with these Terms and Conditions.
18. PERSONAL DATA PROTECTION
Eden Hill places great importance on personal data protection and provides information notes and a Privacy Policy available on www.edenhill.ro.
19. FINAL CLAUSES
Eden Hill reserves the right to modify these Terms and Conditions and the Website without prior notice.
Eden Hill is not responsible for errors on the Website arising from any cause.
